Judge Rodrigo Giménez Uriburu has recused himself from the Federal Oral Court 5 (TOF 5) that is set to judge Cristina Kirchner, her son Máximo Kirchner, and other defendants in the Los Sauces-Hotesur case. He cited potential bias, having previously convicted the former president in the Vialidad case. The judge, who was randomly selected to complete the tribunal on December 26, presented his recusal just days later, arguing that in the Vialidad case, where Kirchner was sentenced to 6 years in prison for fraudulent administration, he evaluated evidence that will be re-examined in this new process, creating a situation of possible prejudgment. The decision aligns with the request by Kirchner's lawyers, who had already called for the judge's recusal for the same reasons. If the recusal is approved, a new draw will be held to complete the tribunal's composition.
